Having trouble repaying your loan in Cyprus? Don't wait for the final call.

If you're having difficulty repaying a loan in Cyprus, it's best to report it to your bank or debt management company before arrears occur. It's possible to change the repayment terms, but ignoring correspondence and missing deadlines can limit the available solutions. It's especially important to act quickly if the loan is secured by real estate.

Restructuring may include extending the loan period, temporarily reducing payments, or spreading arrears over future installments. A lower installment does not always mean a cheaper loan. Before signing a settlement, you must check the total cost, new security features, and the amount of payments after the relief period ends.

Loan restructuring in Cyprus. When to start the conversation?

There's no need to wait for several unpaid installments. It's worth contacting a lender even if your projected income won't be sufficient to make timely repayments.

The cause could be job loss, illness, divorce, the death of a co-borrower, an increase in installments, or business problems. It also matters whether the difficulties are temporary or require a permanent change in schedule.

Upon initial contact, explain the situation and request a list of documents needed to assess your application. It's a good idea to keep a copy of your application and proof of receipt.

The Cyprus Code of Conduct for Borrowers in Financial Difficulty provides for an assessment of repayment options and the search for a lasting solution. However, it has a limited scope of application – not every contract and every borrower are subject to the same rules.

How can a bank change repayment terms?

Possible solutions depend on the borrower's debt, income, expenses, assets, and financial prospects. Options considered may include:

  • Extension of the loan period: lowers the monthly installment, but may increase the total interest.
  • Inclusion of arrears in debt: allows them to be spread over future payments, but does not mean their cancellation.
  • Temporary repayment of interest only: reduces the current burden, but the capital remains to be repaid.
  • Change of schedule: may take into account the entrepreneur's seasonal income.
  • Debt settlement by transferring real estate: requires a clear determination of what part of the obligation is repaid.

Giving back the property does not automatically eliminate the entire debt. The agreement should clearly state whether there will be any remaining balance and what the implications will be for guarantors.

The borrower is not guaranteed to receive the selected option. The lender assesses whether the proposal meets the client's financial capabilities and allows for regular repayments.

Documents needed for the interview

A complete picture of your household or business finances is essential. A bank may require a personal financial statement, known as Personal Financial Statement - PFS, and documents confirming the information provided.

It is worth preparing:

  • loan agreement, annexes and current debt balance;
  • proof of income and bank statements;
  • statement of living costs;
  • information about other loans, cards and guarantees;
  • documents relating to property;
  • confirmation of the cause of the difficulty, if available.

Your own installment proposal should include basic expenses and a reserve for unexpected costs. A promise to pay an amount you can't regularly set aside may only delay the problem.

Trouble Paying Off Your Loan? Start with These Steps

1. Report difficulties

Contact your lender and keep your confirmation of your application.

2. Count the possibilities

A breakdown of income, living expenses, and other liabilities.

3. Check the offer

Compare the total cost and installments applicable after the discounts end.

The scriptures "Θ," "Ι," and "ΙΑ." Don't put them off until later.

In the procedure for the sale of mortgaged real estate, there are notices marked with Greek letters.

Letter "Θ" provides information about the debt, costs, and response time. In the procedure description, the Central Bank of Cyprus specifies that it should be sent if the arrears exceed 120 days.

Letter "I" is a subsequent notification containing a deadline for settling the obligation or submitting a proposal and information about available rights.

Letter "IA" This concerns the next stage of the property sale process. It requires urgent verification of deadlines and possible actions.

These documents should not be treated as simple reminders of your installment payment. Once you receive the notice, you should note the date it was delivered, retain the document, and quickly discuss its implications with your attorney.

Simply starting talks with the bank does not guarantee that the sales process has been suspended. You should obtain clear information about its current status.

What to check before signing the settlement?

It's best to receive a restructuring proposal in writing, along with a timeline. Before signing, it's worth agreeing on:

  • total amount and repayment period;
  • interest rate and the possibility of changing it;
  • installment after the end of the relief period;
  • method of settling overdue interest and fees;
  • required security;
  • consequences of failing to meet the schedule;
  • the situation of co-borrowers and guarantors.

If the settlement concerns a house or apartment where the family lives, an independent analysis of the documents can help avoid liabilities whose effects will only become apparent after several years.

Appeal, mediation and complaint are different procedures

A borrower covered by the Code may use the appeals process with a financial institution. In certain cases, mediation is also available through the Office of the Financial Commissioner.

The terms of mediation include, among other things, an initial commitment limit of 350,000 euros and criteria regarding the property serving as collateral. Short deadlines and restrictions related to the stage of the case apply. Simply meeting the amount limit is not sufficient.

Mediation regarding loan modifications should not be confused with a debt claim during a property sale. The availability and implications of each avenue should be assessed separately.

The settlement should solve the problem in the long run

Restructuring makes sense when the new schedule is sustainable. A temporarily lower payment can help you regain stability, but you need to know what payments will come later.

If the offer exceeds the borrower's financial means, the calculations should be presented and a reassessment requested. Signing an unworkable agreement could lead to further arrears and renewed creditor activity.
