Power of attorney from Cyprus. What can you do without traveling to Poland?

A power of attorney from Cyprus allows you to entrust a trusted person with many matters in Poland. You don't always have to buy a plane ticket to pick up a document or complete the formalities. However, you should first determine what type of power of attorney the office, bank, or notary requires.

In some cases, a written document will suffice. In others, an official signature certification will be required, which can be obtained from the Consular Section of the Polish Embassy in Nicosia. In cases requiring a notarial deed, a signature certification by a consul alone is not sufficient.

Power of Attorney from Cyprus. First, ask the recipient of the document.

You live in Limassol, Larnaca, or Paphos, and in Poland you need to deal with a government matter. You want to authorize your mother, brother, or another trusted person. The natural instinct is to find a template online and enter your details.

It's best to start by contacting the institution where the proxy will be working. Ask if a given action can be performed by another person, what form of power of attorney is required, and whether a specific form is required.

This is particularly important in banks. You shouldn't assume that any document titled "power of attorney" will be accepted for managing an account or signing a contract.

It's also worth agreeing on how the document will be delivered. A scan sent to family members via email won't always replace the original.

Not every power of attorney requires a visit to the consul

A power of attorney specifies who can act on our behalf and to what extent. It may cover a single act or a specific type of matter.

A general power of attorney covers ordinary management activities and must be in writing. However, it does not grant unlimited power to make all decisions concerning our assets.

In practice, the document should clearly indicate the principal, attorney, and scope of the authorization. For specific cases, it's also worth providing identifying information, such as the name of the office or the case number.

Kinship in itself does not imply the right to represent an adult. A parent, spouse, or sibling may need a power of attorney just as much as someone outside the family.

When should you be careful with a notarial deed?

The most important example is a power of attorney to execute a contract transferring ownership of real estate. If your family is to sell an apartment in Poland on your behalf, it's not enough to simply write the authorization and obtain a consular stamp under your signature.

The Polish Embassy in Cyprus clearly states that the certification of the signature on such a document does not replace the required form of a notarial deed.

Therefore, it's best to consult the preparation of a power of attorney in advance with the Polish notary who will be handling the transaction. They should specify the required content and requirements for a document prepared abroad, including any certifications and translations.

How to certify a signature in Nicosia?

If a signature certification is required for a given case, please make an appointment in person via the system. e-Consulate, selecting the "legal matters" category.

You must prepare a document and a valid passport or ID card. This procedure is not handled by sending a photo of the signed document.

According to the instructions published by the embassy, the fee is 40 euro, and the indicated deadline for completion is 7 daysThe document can be collected in person or by an authorized person.

Do you also have to pay in Poland?

The consular fee for signature certification is separate from any stamp duty for submitting a power of attorney in Poland.

In cases covered by such an obligation, the stamp duty is generally 17 PLN. Exemption is provided for, among others, powers of attorney granted to a spouse, parents, grandparents, children, grandchildren and siblings.

However, this does not mean exemption from the consular fee. Please check the rules and the appropriate invoice with the institution receiving the document.

The best approach is simple: first, we determine the recipient's requirements, then prepare the appropriate document, and only then arrange the necessary certification. This way, a power of attorney can truly save you a trip to Poland.
